1. Acceptance of these terms

These Terms & Conditions ("Terms") govern your use of Eat Binary, operated by Log Binary ("Eat Binary", "we", "us"). By creating an account, signing in, or using any part of the Service, you agree to these Terms and to our Privacy Policy. If you use the Service for a business, you confirm that you are authorised to accept these Terms for that business.

2. The Service

Eat Binary is a restaurant operating system. Depending on your plan, it includes some or all of the following modules, all running from one shared menu:

  • Admin back office (partner portal) for menus, staff, reports and settings
  • POS and Captain App for taking and managing orders
  • Online Ordering storefront and Kiosk self-ordering
  • TV Signage menu boards
  • Gift Cards and Loyalty programmes

We may add, change or remove features over time. We will tell you before removing a module you pay for.

3. Accounts and security

  • You must give accurate information when you register, and keep it up to date.
  • You are responsible for your account and for everything done by staff and devices you give access to, including the roles and portal access you assign them.
  • Keep your password and one-time passcodes private. Tell us immediately about any unauthorised use.
  • We may suspend an account that appears to be compromised or that breaks these Terms.

4. Plans, trials and billing

  • Plans are priced in Indian Rupees and billed in advance for the chosen billing period. Optional modules are billed only while they are switched on.
  • Prices do not include applicable taxes such as GST, which are added to your invoice.
  • If you start on a free trial, you will need an active paid plan when the trial ends to keep using paid modules.
  • Fees already paid are non-refundable unless the law requires otherwise or we agree in writing. If you cancel, your plan stays active until the end of the current billing period.
  • We may change prices with at least 30 days' notice. Changes apply from your next billing period.

5. Payments from your customers

Card and online payments from your customers are processed by third-party payment providers such as Stripe and Razorpay, under their own terms. Eat Binary does not charge a commission on your online orders. You are responsible for your prices, taxes, refunds and chargebacks with your customers, and for meeting the payment provider's requirements.

6. Your data and content

You own the content you add to the Service, including menus, images, prices, and your customer and order data. You give us permission to host, copy and display that content only to provide the Service to you.

You are responsible for having the rights to the content you upload, and for collecting your customers' information lawfully. See our Privacy Policy for how we handle personal information.

7. Acceptable use

You agree not to:

  • Use the Service for anything unlawful, fraudulent or harmful.
  • Upload content that infringes someone else's rights, or that is offensive or misleading.
  • Try to access other restaurants' data, or get around access controls or plan limits.
  • Reverse engineer, resell or copy the Service, except where the law allows it.
  • Interfere with the Service, for example by overloading it or introducing malware.

8. Hardware and third-party services

The Service works with hardware and services we do not control, such as terminals, printers, card readers, TV screens, internet connections and payment, SMS and email providers. We are not responsible for their failures, but we will help you troubleshoot where we can.

9. Availability and support

We work to keep the Service available at all times. POS is designed to keep taking orders offline and sync once the connection returns. However, we do not guarantee that the Service will be uninterrupted or error-free, and we may pause it briefly for maintenance. Support is available at support@logbinary.com.

10. Cancellation and account deletion

You can stop using the Service at any time. To delete a partner account, use the Delete Account page. The account is deleted as soon as its email and password are verified, and this cannot be undone.

We may suspend or close an account that breaks these Terms or has unpaid fees. Where possible, we will give you notice and a chance to export your data first.

11. Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties that are not set out in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential losses, such as lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the claim arose.

13. Indemnity

You agree to compensate us for claims, losses and costs arising from your content, how you use the Service, or a breach of these Terms by you or your staff.

14. Changes to these terms

We may update these Terms from time to time. We will change the "Last updated" date above and tell partners about significant changes in advance. If you keep using the Service after the changes take effect, you accept the updated Terms.
